Forget the Olympics! Try racing with a burro

Rumor has it that there?s a big sporting event taking place in London over the next couple of weeks. But if you really want to watch athletes push themselves to the limit, you might want to head to Fairplay, Colo., this weekend instead.

That?s where you?ll find a crowd of upwards of 10,000 people celebrating Burro Days?(July 28??29) and cheering on the competitors in the 64th annual World Championship Pack Burro Race.

What makes the event so extreme, you ask?

It could be the 29-mile course over dirt roads, boulder fields and snow.

Or, it could be the altitude, which is literally breathtaking, as the course climbs from 10,000 feet in town to 13,158 feet at the top of nearby Mosquito Pass and then back down.

Oh, and did we mention that each racer has to run the course while tethered to a donkey carrying 33 pounds of gear, including a pick, shovel and gold pan? Competitors may find themselves pulling, pushing, pleading, even bribing with food ? everything, in fact, except actually riding their burro ? while living up to the race?s official motto of ?64 Years of Hauling Ass.?

In other words, forget the Olympic motto of ?Citius, Altius, Fortius? (Faster, Higher, Stronger). This race is more like ?Citius, Altius, Asinus? (Faster, Higher, Donkeys), which is why we hereby officially decree Burro Days as Overhead Bin?s Weird Festival of the Month for July.

Like many homegrown festivals, Burro Days has both a genesis story ? two long-ago miners racing to town with their heavily loaded burros, both hoping to lay claim to the same patch of ground ? and a basis in the modern-day challenge of boosting tourism in small, out-of-the-way places.

?It was first proposed as a challenge in 1949 and it went out to anyone who wanted to race from Leadville to Fairplay,? said Julie Bullock, president of the festival?s burro committee. ?They were probably sitting in a bar at the time.?

Today, the festivities have expanded to include llama races, in which runners lead their charges through a three-mile obstacle course; dog races, in which kids compete alongside their pack-laden pets; and outhouse races, which should be pretty self-explanatory.

But the pack burro race is clearly the marquee event, albeit one that even competitors admit can cause some head-scratching among the uninitiated.

?The idea that you can get an animal not known for its cooperation to traverse 30 miles of ridiculous roads and open country to 13,000 feet and back for cash money sounds ludicrous,? said Curtis Imrie, a 40-year competitor and three-time world champion.

But, he said, donkeys? seeming stubbornness is really just the flip-side of their peaceful demeanor: patience in the face of suffering and underlying intelligence.

?In my experience, the race is a cross between a wrestling match, a 24-hour dance contest and an endurance race,? he told NBC News. ?You have to have the humility to realize your partner is a jackass. The lessons they can teach you ? counterintuitive or not ? are profound.?

Clearly, this is not your average footrace, which may also explain why the Colorado Legislature officially designated pack burro racing as the state?s first-ever summer heritage sport in May.

Alas, that designation probably won?t raise the sport?s profile much beyond Colorado, but?it?s hard not to root for the hardy souls who accept the challenge to ?haul yer ass up the pass.?

?People should TiVo the Olympics,? said Julie Bullock. ?You can?t TiVo the burro race ? you have to be here in person.?

Leasing or capitalizing? | Office ToDo

There are some people and companies that prefer leasing over owning assets. For the purpose of the argument, we do mean operational lease and not finance lease in here. It?s ownership versus renting.
I guess it comes down to priorities. Whether it?s important for you to own the asset and not worry about cash or simply rent it and pay for it as a regular service you?d buy. One option gives you the ownership but also all the accompanying risks, but doesn?t result in a regular cash outflows. The other option means you?ve got minimal risks and none relating to ownership, but you do have to pay a sum of money each period.

Pro capitalizing people would say that owning an asset gives you the freedom to use it whenever however and modify it as you see fit. They?d also say that not having to worry about regular cash outflows is a huge bonus.

Pro renting people would say that they do not want the risks and they outweigh the benefits received from owning the asset. They do see the monthly charge as compensation that someone else owns the risks.
There are pros and cons to both, but in my opinion it really comes down to the question whether you are able to accept the risks that come with ownership or you?re willing to give away bits of your freedom in business making. It?s up to you entirely. Something that?s also a possible incentive is the cash outflow of course. How important is it for you to have free cash?

Florida Construction Contracts Need More Than Two Pages to Be ...

I?m asked occasionally to recommend a simple 2-page construction contract for states like Florida.

Where can I get a contract like that?

If you see one of these two-page wonders, you can be sure it?s junk ? at least in the State of Florida. The legislators in Tallahassee have seen to that. Every valid Florida construction contract will include several pages of notices and disclosures required by Florida law.

If you?ve been using a two-page contract for residential construction in Florida, here?s a handy guide to what you?re missing.

Opportunity to Repair (Florida Statures Chapter 558.005)

Every construction contract in Florida (except public transportation projects) must include the ?notice of claim? statement. The contract is still valid if you omit this statement. But the fine for leaving it out is $500 under Florida Statutes ? 775.08(3).

Buyer?s Right to Cancel (Florida Statutes ? 501.031)

Unless the deal was closed at a state fair, at your office or after an express invitation to visit your client at home, residential contracts have to give notice of the buyer?s right to cancel.

If the deal was closed, for example, over lunch in a restaurant, on the phone, by email, on a golf course or at an architect?s office, it?s a home solicitation sale. I know that doesn?t make much sense. But it?s Florida law. The notice is required. Omission of the notice is a first degree misdemeanor punishable by up to a year in prison and a $1,000 fine under Florida Statutes ? 775.082 and ? 775.083.

Florida Construction Lien Notice (Florida Statutes ? 713.015)

This notice has to appear in all residential prime contracts valued at $2,500 or more if work is either new construction or improvement of a building with four units or less. The notice has to be in 12-point bold caps and either on the front page of the contract or on a separate page. If the notice is on a separate page, this statement has to be signed by the owner and dated. Omitting this notice is a non-criminal violation punishable by a fine of up to $500 under Florida Statutes ? 775.08(3) and may make it difficult for a prime contractor to enforce lien rights.

Construction Industry Recovery Fund Notice (Florida Statutes ? 489.1425)

Omission of this notice is punishable by a fine of up to $500 for the first offense and up to $1,000 for a second or subsequent offense.

The Home Improvement Sales and Finance Act. (Florida Statutes ? 520.73)

If a home improvement contract includes a finance charge, Florida law requires a statement in 10-point bold type directly above the owner?s signature. Omission of this notice requires a credit of all delinquency fees charged, plus attorney fees and costs.

If your Florida contracts fudge on these notices, you have an excuse. Some of these required notices are new. The right to repair notice became effective October 1, 2006. The lien notice law became effective in the present form on July 1, 2007.

This checklist covers only notices required by Florida law. Of course, all Florida contracts have to comply with Federal law ? the 3-day right to cancel (12 C.F.R. 226.15 ), Federal Truth in Lending (15 U.S.C. 1601) and insulation disclosures (16 C.F.R. 460). If you do home improvement work in zips between 33010 and 34141, Miami-Dade Municipal Code ? 10-33 requires additional disclosures.

Even if you?re not concerned about the threat of fines and jail time, there are good reasons to keep your contracts legal under Florida law. Get into a dispute on any job and the attorney for the other side will hammer away at every little flaw and blemish in your contract. You could be left with no way to collect.

So while a two-page construction contract may be easy to get the owner to sign, it may not be completely legal under Florida law. It certainly offers little or no protection should something go wrong. Unfortunately, most forms available on the Internet today do not cover the provisions required by Florida contract law.

Michael begins with a comparison to environmentalism: Stewardship of valuable resources, and long-term planning. There are cognitive challenges, and issues in providing institutional incentives. (He recommends sucking in as much data as possible, and worrying about adding the metadata later, perhaps through crowdsourcing.)

Michael notes that copyright used to be an opt-in and opt-out system; you had to register, and deposit a copy. Then you had to publish with a ?; anything published before 1989 that doesn?t have the ? is in the public domain. You had to renew after 28 years, and the majority of copyrights (60%) were not renewed. We therefore had a growing public domain.

The court in Golan upheld Congress? right to restore copyright for works published outside the US. This puts the public domain at risk, he says. He also points to the Hathi case in which they?ve been sued for decisions they made about orphan works. There is a dangerous argument being made there that if archiving occurs within the library space, fair use goes away. The legal environment is thus unstable.

Now that copyright is automatic and lasts for 70 years after the author?s death, managing the rights in order to preserve the content is fraught with difficulty.

He reminds us that making a copy to preserve the work is unlikely to have market harm to the copyright owner, and thus ought to be legal under fair use, Michael says. ?You ought to have a bias toward believing you have a Fair Use right to preserve things.?

He asks: ?Can the preservation community organize itself to be the voice of tomorrow?s users on issues of copyright policy and copyright estate planning?? For orphan works, copyright term shortening, exceptions to DRM rules, good practices open licensing in the long term?

And he asks: How can you get the FBs and Googles et al. to support long-term preservation? Michael suggests marking things that already in the public domain as being in the public domain. Otherwise, the public domain is invisible. And think about ?springing? licenses, e.g. an open license that only goes into effect after a set time or under a particular circumstance.

Bill Stouffer, Missouri Secretary Of State Candidate, Receives Thousands In Free Billboard Ads

Missouri's billboard industry has provided over $72,000 in free advertising to a Republican candidate for secretary of state after he pushed legislation favorable to the industry in the state Senate.

Sen. Bill Stouffer (R-Napton) has received $72,809 in in-kind donations from three billboard companies, including $56,609 from Lamar Companies, according to state campaign finance records. Stouffer is one of three Republicans seeking the GOP nod for the open secretary of state's job in the Aug. 7 primary. Stouffer, the chairman of the Senate Transportation Committee, has been known for advocacy for pro-billboard related legislation over the years. The head of the state's billboard lobby indicated that this support won Stouffer the donations, which have come in the form of free space on billboards across the state.

"I encouraged our people to support him," Bill May, the executive director of the Missouri Outdoor Advertising Association, told The Huffington Post. "Oh my gosh, the whole time Bill Stouffer has been in the Senate, he has more appreciation and understanding of our industry than anyone. He supported us when people tried to eliminate billboards."

Stouffer for several years pushed legislation to permit the creation of electronic billboards in the state and to allow the state to relocate older billboards when highways are widened, instead of destroying them. The two issues, which were signed into law by Gov. Jay Nixon (D) this year, have long been championed by the Outdoor Advertising Association.

May said Stouffer has worked on other billboard-related issues in the Senate, particularly in terms of his committee's role in overseeing the state Department of Transportation, which regulates billboards.

"He is one of those guys you did not have to explain the benefits of outdoor advertising to the state economy," May said.

A spokesman for Lamar Companies indicated that May has coordinated the effort on behalf of the billboard industry to help Stouffer and said as many as 10 billboard companies could get involved. May said he estimates between five and 10 companies will provide in-kind donations to Stouffer.

Stouffer also reported $8,200 from DDI Media and $8,000 from Porlier Outdoor Advertising recently. The billboards show Stouffer farming and with his dog.

Stouffer is facing off against Rep. Shane Schoeller of Willard and Sen. Scott Rupp of Wentzville in the GOP primary; the winner will face Democratic Rep. Jason Kander of Kansas City in November. Stouffer's spokesman, Chasen Bullock, referred phone questions to email and did not respond to email or phone messages.

May said the association considered backing Schoeller who is considered the frontrunner in the GOP primary. He said Schoeller may receive some help in the primary but would likely receive help from the billboard industry should he win the primary and face Kander in November.

"Frankly, our people also like (Schoeller), I would put him in the same category," May said. "Most of our people know Stouffer better. Both are personal friends of mine. I've known both a long time."

Schoeller, who worked for U.S. Sen. Roy Blunt (R) and former Gov. Matt Blunt (R) in the secretary of state's office, did not return a message left with his campaign.

Missouri is known for open-ended campaign finance laws that allow candidates to collect large donations. In the GOP lieutenant governor primary, Sen. Brad Lager (R-Maryville) received $250,000 donations from individuals in his race.

May said there are about 8,800 and 8,900 billboards across the state, and the change to electronic billboards will benefit the statewide economy and emergency management. Electronic billboards could broadcast Amber Alerts and FEMA messages, he said, and would allow for fewer billboards since the electronic signs could carry multiple messages. Missouri is known for a proliferation of billboards across the state, centered primarily in the tourist-heavy areas of Branson and Springfield.

"We are a big tourism state and we have a lot of tourism business in the state," he said. "Gas stations, the caves, and places like Branson account for the big part of the state."

Jeanne Kelly: What Your Wedding Day Means for Your Credit

Congratulations! It's your big day! You've been planning for months and now you're walking down the aisle. You look amazing. He looks handsome. Everyone is there to celebrate. It's everything you've dreamed about.

Among all of the invitations and preparations and parties and well-wishes, there is a lot to deal with when it comes to your wedding. So the last thing on your mind is probably your credit rating! (And truth be told, it's possible that your credit card might have taken a hit or two for that gorgeous bouquet or a down payment on your bridal gown).

Your wedding might be the most important thing on your mind right now... but here's what you need to know about how your wedding day affects your credit. After you say "I do" and slip the ring onto each other's fingers, you are accepting that person for better or for worse... INCLUDING their credit score.

Here's what you need to know about your spouse and their credit.

Credit scores are individual. Therefore, whatever credit score you brought into the marriage remains with you -- to decline or improve (hopefully improve!) all by yourself. There are no "joint" credit scores and your husband's bad or great credit score won't become yours just because you now share the same address and last name.

Your credit scores will continue to be your own individual scores throughout marriage. Your individual credit scores will be used to determine whether you qualify for loans. If only one of you applies for a loan, only that person's credit score will be used to get the loan. The other person's credit score won't be accessed or impacted. If you both sign for a loan, both of your credit reports will be pulled. If the loan becomes overdue, both of your credit scores will be impacted as that account is joint. Therefore, it makes sense for only one person to apply for a loan when necessary. (Sometimes it's not possible -- there might be situations where you both have to apply -- but for the most part, try to have only one person apply).

Whenever possible, keep individual accounts (bank accounts, credit cards, and even utility bills) to shelter each other's credit score if something should happen. By doing this, you can spread the risk a little bit: If you default on a few accounts, both credit scores are only impacted slightly instead of both credit reports taking the full brunt of all of the defaults.

On your special day, the last thing you want to think about is your credit. But if you keep these tips in mind while you plan your life together, you'll enjoy far better credit scores and you'll protect yourselves in case something unexpected happens.
